These Terms and Conditions (hereinafter referred to as the “Terms”) govern the use of the website and mobile application (hereinafter referred to as the “Service”) provided by Next Make Co., Ltd. (hereinafter referred to as the “Company,” “we,” or “us”).
By accessing, registering, or using the Service, the user (hereinafter “User” or “you”) is deemed to have agreed to these Terms.
1.Introduction
These Terms apply to all features of the Service, including the ticket purchasing functions and digital guide services provided by the Company.
By creating an account or purchasing a ticket, you acknowledge and agree to these Terms.
2.Definitions
The following terms shall have the meanings set forth below:
- “User / You”
An individual who uses the Service and purchases tickets or digital guide services.
- “Company / We / Us”
Next Make Co., Ltd., the operator of the Service.
- “Account”
A user profile created through email registration or social login.
- “Companion”
Additional visitors whose information (e.g., date of birth, gender) is entered by the User during ticket purchase.
- “Ticket Purchase”
The act of ordering and completing payment for tickets through the Service.
- “Electronic Ticket (E-ticket)”
A digital ticket issued upon successful payment.
- “Website”
The official site operated by the Company.
- “Mobile Application / App”
The application provided by the Company.
3. Account Registration
- Users may create an account using an email address and password or through social login approved by the Company.
- Users must provide accurate, complete, and up-to-date information.
- Minors may use the Service only with appropriate supervision or parental consent as required by applicable laws.
- The Company may suspend or delete an account if false information is registered.
4. Management of Login Information
- Users are responsible for securely managing their login information.
- All actions performed under a User’s account shall be considered the actions of the User.
- The Company bears no responsibility for damages arising from inadequate management of login information.
5. Ticket Purchase
By purchasing tickets through the Service, the User agrees to:
- Comply with all payment-related conditions.
- Contact the Company first in the event of purchase issues and follow the Company’s instructions.
- Take financial responsibility for all purchases made through their account.
- Ensure the accuracy of all companion information.
- Prepare a device capable of displaying the electronic ticket and QR code upon arrival.
6. Formation of Contract
The Company does not operate tourist facilities and acts only as a ticket sales agent or reservation intermediary.
The Company is not responsible for the content, quality, safety, schedule changes, or cancellation of services provided by the facilities.
7. Pricing and Payment
7.1 Pricing
- Ticket prices are displayed in USD and are finalized on the confirmation screen prior to payment.
- The displayed amount is the final amount billed.
- The actual charged amount may vary due to exchange rates or card issuer fees.
7.2 Payment Methods
- Payments are processed through third-party payment services such as Stripe.
- Valid credit or debit card information is required.
- After successful payment, an E-ticket and receipt will be sent via email.
- If a payment error occurs, Users must contact the Company and cooperate with the investigation.
8. Refund Policy (No Refunds)
No cancellations, changes, or refunds will be accepted for any reason after the purchase is finalized.
Refunds will not be issued in cases such as:
- User’s schedule changes
- Delays, illness, weather, or disasters
- Inability to display QR code due to device issues
- Incorrect purchase details
- Partial service unavailability (e.g., guide features)
Refunds or reissuance will be provided only if:
- Duplicate payment is caused by the Company’s system error
- The User cannot complete purchase due to the Company’s gross negligence
9. Visitor and Ticket Restrictions
- Tickets may be purchased only by Users 12 years or older (under 12 must be supervised).
- Ticket quantity per order may be limited (e.g., max 5 per order).
- Tickets may only be used by the purchaser and registered companions.
- Resale, transfer, or duplication is prohibited.
10. Electronic Tickets and QR Codes
- All issued tickets are electronic tickets.
- Users must present the electronic ticket via the App or email upon arrival.
- QR code duplication, modification, or sharing is prohibited.
- The Company is not responsible if QR codes cannot be displayed due to device issues.
- Retention of Purchase Proof
To prepare for situations where E-tickets cannot be displayed due to app malfunction, communication errors, email delivery issues, or device problems,
Users are responsible for saving and retaining screenshots of the purchase confirmation page, the E-ticket screen, or confirmation emails as proof of ticket purchase.
The Company shall not be liable for any disadvantages (including denial of entry, inability to reissue, or inability to use the ticket) arising from the User’s failure to retain such proof.
11. Digital Guide Content
- The Company provides audio, video, and text guide content.
- Recording, saving, or redistribution is prohibited.
- The accuracy or completeness of the guide content is not guaranteed.
- Available languages may vary by facility or region.
12. Prohibited Activities
Users must not:
- Provide false information
- Duplicate, alter, or misuse QR codes or tickets
- Attempt unauthorized access
- Interfere with servers or networks
- Engage in fraudulent or unlawful activities
- Infringe intellectual property rights
13. Service Modifications or Suspension
The Company may modify or suspend the Service without notice due to:
- System maintenance
- Technical issues
- Security requirements
- Operational reasons
The Company is not responsible for resulting damages.
14. Intellectual Property Rights
All images, audio, video, text, software, and other content are owned by or licensed to the Company.
Unauthorized use, reproduction, or modification is prohibited.
15. Third-Party Services
The Service integrates external services such as Stripe.
The Company is not responsible for their content, safety, performance, or terms.
16. Disclaimer
The Company is not responsible for:
- Operations, quality, safety, closures, or delays caused by facilities
- User device or network issues
- Weather, disasters, or force majeure
- Indirect or consequential damages
The Company’s liability, if any, is limited to direct damages up to the ticket purchase amount and only in cases of gross negligence.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Kingdom of Cambodia.
Disputes shall be subject to the exclusive jurisdiction of a court designated by the Company.
